Affidavit of Support

Form I-864 is a legally binding contract required for most family-based and some employment-based immigration applications. By signing this form, you agree to financially support the immigrant until they become U.S. citizens or can be credited with 40 quarters of work.

Legal ContractThe I-864 is a legally enforceable contract that can be used by the government or the immigrant to obtain financial support from the sponsor.
Duration of ObligationYour financial responsibility continues until the immigrant becomes a U.S. citizen, works for 10 years (40 quarters), leaves the U.S. permanently, or dies.
USCIS Filing FeeThere is no separate filing fee for Form I-864; it's submitted as supporting documentation with the immigrant's application.
Financial RequirementsThe sponsor must demonstrate income at or above 125% of the Federal Poverty Guidelines for their household size (100% for active military).
Joint SponsorsIf you don't meet the income requirements, you may use a joint sponsor who will share financial responsibility for the immigrant.
Sponsor Requirements

To serve as a financial sponsor using Form I-864, you must meet these requirements:

U.S. Citizen or Permanent Resident

Must be a U.S. citizen or lawful permanent resident (green card holder)

Income Threshold

Must have income at or above 125% of the Federal Poverty Guidelines for your household size including the immigrant(s)

Domicile Requirement

Must maintain your principal residence in the United States or a U.S. territory

Age Requirement

Must be at least 18 years of age to legally sign the affidavit

Relationship Requirement

In most cases, must be the person who filed the immigrant petition for the intending immigrant

Household Size CalculationWhen determining your household size for income requirements, you must include yourself, your dependents, any relatives living with you whom you claim as dependents, and all immigrants you're sponsoring on Form I-864.
Form VariationsThere are different versions of this form: I-864 (standard), I-864EZ (simplified version for certain sponsors), and I-864W (exemption form for those who don't need an Affidavit of Support).
Address Change RequirementSponsors must notify USCIS of any address changes within 30 days using Form I-865, or face penalties of $250 to $5,000.
