Form I-134 is used by sponsors to demonstrate they have sufficient financial resources to support a foreign national visiting or immigrating to the United States. This form is a critical component of certain immigration applications, including K-1 fiancé(e) visa petitions (I-129F).

Preventing Public Charge Concerns

Purpose of I-134The I-134 is used to show that a foreign national will not become a public charge (dependent on government assistance) while in the United States.
No USCIS Filing FeeThere is no separate filing fee for Form I-134, as it's submitted as supporting documentation with other applications.
Part of Visa ProcessFor K-1 fiancé(e) visas, this form is included with the I-129F package and is a critical document reviewed during the visa interview.
Financial RequirementsThe sponsor must demonstrate income at or above 100% of the Federal Poverty Guidelines for their household size including the beneficiary.

Sponsor Requirements

To serve as a financial sponsor using Form I-134, you must meet these requirements:

U.S. Citizen or Permanent Resident

Must be a U.S. citizen, lawful permanent resident, or U.S. national

Income Threshold

Must have income at or above 100% of the Federal Poverty Guidelines for your household size plus the immigrant

Domicile Requirement

Must maintain your principal residence in the United States

Age Requirement

Must be at least 18 years of age to legally sign the affidavit

Financial Stability

Should be able to demonstrate stable income and/or sufficient assets to support the immigrant

Important Notes About I-134

Not Legally EnforceableUnlike Form I-864, the I-134 is not considered a legally enforceable contract. However, making false statements on the form can result in penalties for perjury.
Consular DiscretionConsular officers have significant discretion in determining whether the financial support demonstrated is sufficient. Strong documentation is essential.
Preparation TimingThis form should be prepared close to the beneficiary's visa interview date to ensure the financial information is current.
